It is shown that the Fermi-Watson theorem for the final state interaction in the reaction $e^ + e^-\\to\\rho\\to\\gamma\\pi^ + \\pi^-$ is not valid in the case of soft photons, $\\omega < 100$ MeV, in the $\\phi$ meson region.
